PURPOSE: To assist the health department's environmental health division integration with the county and assist with the health department's enforcement cases.

BACKGROUND: As part of the creation of a new county health department, on October 26, 2022, the county council adopted amended ordinance 22-062, which repealed various other chapters of title 7, health and sanitation, including chapters 7.04, 7.08, 7.12, 7.16, 7.20, 7.28 and 7.32 SCC. These chapters were substantively obsolete, dating back to a 1962 county resolution and never updated. In addition, the chapters addressed health and sanitation areas that have long since been administered by the state board of health and local health authorities. Chapter 7.44 could have been included in this repeal but was not captured in the October 2022 ordinance. Chapter 7.44 Snohomish county code was originally adopted by 1962 county resolution and amended in 1970 and has not been substantively updated in decades. In present day, the regulation of sewer disposal systems is subject to comprehensive statewide regulations administered by the county health department under chapter 70A.105 RCW & chapter 246-272A WAC. The county planning department has also had a nominal role with regulating connections to public sewer and on-site septic systems associated with development activity under the Growth Management Act, chapter 36.70A RCW.
