PURPOSE: Obtain approval of Amendments to contract for Legal services to reflect law firm merger.
BACKGROUND: .
• Long term tenants of the Snohomish County Airport and other outside entities may have caused or contributed to hazardous waste, substances, pollutants and contaminants on various locations of Airport property.
• By previous motions (20-254, 20-256, 21-193), Snohomish County has entered into three legal professional services agreements with Joyce Ziker Partners, PLLC for consultation and legal advice regarding various areas at the Snohomish County Airport.
• The law firm of Joyce Ziker Partners, PLLC joined Hillis Clark Martin & Peterson, P.S. (“HCMP”) effective January 1, 2023.
• The Amendments to each of the contracts revise the name of the law firm providing services and also provide an updated fee schedule for compensation. Further, Amendment No.1 to Other Areas provides additional compensation of $50,000 not to exceed a total contract amount of $125,000.
• Continuing advice from the same attorneys who are now at the HCMP firm is critical to potential legal action, remedies and damages is necessitated by such tenancy and environmental issues.

DEPARTMENT FISCAL IMPACT NOTES: There is no fiscal change except for Amendment No.1 , “Other Areas” which is adding $50,000 to their contract which is budgeted for in the Airports 2023 budget.
