PURPOSE: Authorize County Executive to sign a Cable Franchise Agreement reimbursement letter and allocate future cable franchise fee payments for costs incurred during cable franchise development - Application/Processing Fees required the County
BACKGROUND: Comcast Cable Communications, LLC and Comcast Cable Communications Management, LLC, both Washington corporations, have jointly applied to Snohomish County for cable franchise renewal, allowing continued non-exclusive use of the right-of-way to construct, operate, and maintain a Cable System in unincorporated Snohomish County. The Comcast Cable franchise was approved by County Council on July 13 under Ordinance 22-029. The County requires payment of all fees related to the application and processing of the franchise agreement. During development of the Comcast franchise, the Department of Public Works (DPW) incurred costs for staff time in the amount of $44,107.68, legal costs of $28,157, and consultant costs of $64,900 for the development of the Cable Needs Assessment Report. Requesting approval, authorizing the County Executive to sign/send a letter to Comcast requesting reimbursement of staff time of $44,107.68, with the understanding future cable franchise fee payments may be reduced by the reimbursed amount of $44,107.68. Requesting approval, authorizing Finance to allocate a portion of the next Comcast cable franchise fee payment (after approval of the Comcast franchise) as required to reimburse Road Fund for legal and consultant costs.

DEPARTMENT FISCAL IMPACT NOTES: Comcast will pay cable franchise fees in the amount of $44,107.68. These costs have already been incurred by PW in the negotiation of the Comcast Franchise Agreement. The next Cable Franchise Fee payment, which is anticipated at approximately $750,000, would be reduced by $44,107.68. Additionally, PW would be reimbursed $90,057 from the Cable Franchise fee for legal and consultant costs incurred during the negotiation of the Comcast Cable Franchise.
