PURPOSE: Snohomish County Council approval of the Developer Extension Agreement and the Bill of Sale and to authorize the Property Officer of the Department of Facilities and Fleet to sign on behalf of the County the Developer Extension Agreement and the Bill of Sale and any other documents necessary to effectuate the terms and conditions set forth in the Developer Extension Agreement.

 

BACKGROUND: On September 18, 2019 County Council approved Motion 19-298 authorizing improvements to be constructed on County-owned Flowing Lake Park property located at 17900 48th Street SE, in Snohomish, Washington (the “Property”).  Snohomish County Department of Conservation and Natural Resources (“Department”) is now in the process of making those improvements to the Property. The improvements require the installation of and extension of a water main and appurtenances (the “Improvements”) to be installed on the Property.  Three Lakes Water Association as the water provider, requires the County as Property owner to enter into a Developer Extension Agreement (“DEA”) for the water utility services.  Execution of the DEA by the County is required as a part of the development of the Property.  Under the terms and conditions of the DEA the County is required as the property owner to execute a Bill of Sale for the water extension to the Three Lakes Water Association once the utility is installed on the Property.  The Property Management Division of the Department of Facilities and Fleet recommends County Council approve of the DEA to make the improvements to the Property and the surplus and disposition of the water main and appurtenances by executing a Bill of Sale to transfer the Improvements to Three Lakes Water Association.   Special Note:  The Director of the Department signed the DEA in error without knowing signature authorization was required by County Council instead prior to any signature by the County.
