PURPOSE: Approval of updated substantive term and language to lease form template at Snohomish County Airport in accord with SCC 2.10.010(12).
BACKGROUND:
• Snohomish County Airport is authorized to enter and sign leases pursuant to SCC 2.10.010(12), which provides, among other items, terms and form may be changed from time to time by the county council.
• Airport seeks approval of new lease terms for NPDES Compliance obligation in accordance with the 1972 Clean Water Act, effective August 1, 2023.
• The National Pollutant Discharge Elimination System (NPDES) permit program, created in 1972 by the Clean Water Act (CWA), helps address water pollution by regulating point sources that discharge pollutants to waters of the United States. In Washington State, authority over the program is given to Washington State Department of Ecology (DOE). Permits pursuant to NPDES are an obligation of a lessee at the Snohomish County Airport.
• It is in the best interest of the Airport to update the lease form to add Lessee obligations for permitting requirements in compliance with NPDES.
