PURPOSE: This Conservation Covenant complies with the requirements of the Department of Ecology’s 401 Water Quality Certification Order #85631 and corrected Order #18224, approving the use of the Little Bear Creek Advance Mitigation Site Project (RC1730) for advance mitigation.
BACKGROUND: The Little Bear Creek Advance Mitigation Site was approved for construction by the Snohomish County Council in January 2022. As part of the regulatory permitting process, a Critical Area Study dated August 2019 was required in order to receive all regulatory permits and to construct this project. The Critical Area Study and permitting requirements called for the entire project site to be left permanently undisturbed in a substantially natural state after construction. Permanent protection of this advance mitigation site requires approval by the Snohomish County Council and recording of the Conservation Covenant with the County Auditor.
