PURPOSE: To review and take action on a proposed sewer district annexation

BACKGROUND: The Lake Stevens Sewer District submitted a Notice of Intention (NOI) to the BRB for the PM 10 Annexation that was filed on February 2, 2026 (File No. 2026-01). The BRB 45-day review period will end on March 19, 2026, at 4:00 p.m. However, per RCW 57.02.040(2), the County Council must, within thirty days of receiving notice of the proposed action, approve the action or hold a hearing on the action and transmit to the BRB a report of its approval or disapproval of the proposed action together with its findings and recommendations under RCW 57.02.040. The 30-day review period for County Council to act on the proposed sewer annexation expires March 4, 2026. The area proposed for annexation is approximately 2.2 acres and located within the City of Lake Stevens city limits. The location of the proposed sewer annexation is north of 20th St SE and south of 18th St SE. There are no residences and the population is zero. Based on County review, PDS concludes that the PM 10 Annexation proposal by the Lake Stevens Sewer District, BRB File No. 2026-01, is consistent with the applicable statutory provisions governing special district annexations. The recommendation to the County Council from PDS is to not invoke the jurisdiction of the BRB and approve the PM 10 Annexation by the Lake Stevens Sewer District.
