PURPOSE: The proposed ordinance formally dissolves the Lochsloy Pilchuck Flood Control District.

BACKGROUND: Lochsloy Pilchuck Flood Control District (The District) was created in 2016 and had commissioners appointed by Council, but has not held commissioner elections since the initial appointments.

Since the District has not held elections in the preceding seven years, it meets one of the requirements under RCW 36.96.010 for being considered inactive.

The District has not carried out any of the special purposes or functions for which it was formed within the preceding consecutive five-year period, which meets a second condition under RCW 36.96.010 for being considered inactive.

The District has never imposed assessments on properties within the District and has no assets. District commissioners have declined to proceed with any proposed improvements, and with levying of assessments, due to the estimated costs of the proposed improvements and the inability to obtain necessary permits for the improvements.

SWM has mailed letters to all commissioners and district residents requesting any feedback or concerns about dissolving the district, and SWM received no responses.
