EXECUTIVE RECOMMENDATION: Approved
PURPOSE: The purpose is to deliver a cease-and-desist notice to Licensee for unauthorized activities including possible encroachment by Licensee onto adjacent property(s) to County’s Kayak Point Golf Course.
BACKGROUND: The County received complaints from adjacent property owners of possible encroachments on their property by Licensee’s activities of cutting and clearing vegetation within the adjacent owners’ property boundary. Additionally, County staff identified trees felling activities of trees with a diameter of 8-12 inches which exceeds the 4” diameter threshold and requires prior County consent to cutting pursuant to License Section 2.14 Maintenance. Therefore, County intends to issue a cease-and-desist order to Licensee, and commission a boundary survey to confirm or disprove the encroachment claim(s) by adjacent property owners
