ORAL MOTION
Council Vice-Chair Nehring made a motion for the Council 1) to authorize and approve the Settlement Agreement signed by Mr. Kevin Kucera on behalf of Plaintiffs GNP RLY, Inc. and Northwest Signal Maintenance, LLC, on July 27, 2023, which Settlement Agreement shall resolve the civil cause of GNP RLY, INC., et al., vs. Snohomish County, et al., Snohomish County Superior Court no. 21-2-03931-31, and provide for eventual railbanking of the rail line at issue in accordance with applicable federal law, for the amount of $250,000 and other consideration, as negotiated on behalf of the County by the Prosecuting Attorney’s Office, and 2) to authorize the County Executive or his designee to sign the documents necessary to memorialize and effectuate the Settlement Agreement, in consultation with the Office of the Prosecuting Attorney. Councilmember Low seconded the motion and it carried unanimously.
