PURPOSE: To review and approve an annexation into the Lake Stevens Sewer District service area.

BACKGROUND: The Boundary Review Board (BRB) filed on August 27, 2024, a third amendment Notice of Intention (NOI) submitted by the Lake Stevens Sewer District ("the District"). The BRB 45-day review period will end on October 11, 2024, at 4:00 p.m. However, per RCW 57.02.040(2), the 30-day review period for County Council to act on the proposed sewer annexation expires September 26, 2024.This a Direct Petition method of annexation for two properties totaling approximately 6.08 acres. The area proposed for annexation is located southeast of Machias Cutoff Rd and 123rd Ave SE, and north of 20th St SE, and was recently annexed into the City of Lake Stevens and part of the Southeast Interlocal Annexation, effective August 9, 2021. As part of the interlocal agreement for the Southeast ILA Annexation, the City agreed to maintain a residential minimum net density of 4 dwelling units per acre and the District proposed future areas for annexation into its service district boundaries that include the area proposed in this Gamble Annexation. Based on County review, PDS concludes in its staff report dated September 10, 2024, that the Gamble Annexation proposal by the Lake Stevens Sewer District is consistent with the applicable statutory provisions governing special district annexations. The recommendation to the County Council from PDS is to not invoke the jurisdiction of the BRB and approve the Gamble Annexation by the Lake Stevens Sewer District.
