PURPOSE: County Council approval of the draft Aquatic Lands Lease ("Lease") between state of Washington acting through Department of Natural Resources ("DNR") and Snohomish County ("County") and to authorize the Director of Facilities and Fleet to execute the final Lease and any other documents necessary to facilitate the Aquatic Lands Lease and to carry out the terms and conditions of said Lease. The state requires this draft lease to be approved before Janae Nelson can sign the document at a future date with a notary present.

BACKGROUND: Snohomish County Division of Parks and Recreation owns property known as Kayak Point Regional Park which has access to bedlands of Port Susan. Kayak Point Regional Park supports day use and overnight recreation activities including picnicking, camping, boating, swimming, and fishing on shorelands and bedlands owned by the County, as well as a fishing pier which extends out into a portion of the aquatic lands of Port Susan, which are owned by the State of Washington. This Lease will allow the County to construct improvements on state-owned aquatic lands that include renovation of the existing fishing pier for safety, improved ADA accessibility, current habitat stewardship requirements, and ongoing public access to the water. This Lease also allows the County to use the portion of the state-owned aquatic lands around the fishing pier for a period of 30 years beginning July 1, 2023, and ending June 30, 2053. There is no cost to the County associated with the Lease as the land is available to the public for use and access to aquatic lands for boating, fishing, and swimming in accordance to WAC 332-30-131.
