PURPOSE: Terminating access easement as part of the Dike Removal and Repair Project on Spencer Island at Union Slough

BACKGROUND: On February 17, 1947, Snohomish County was granted an easement for county road across the south 40 feet of Spencer Island under document recorded under Auditor's File No. 841561. Since being granted said easement, the road was never developed nor was the easement used for the intended purposes. Also, since being granted said easement, the dike system on Spencer Island has failed numerous times requiring removal of some diking and repair of other portions. Currently the County is working with the US Army Corps of Engineers (USACE) to rework the diking system and repair boardwalks and bridges for the island at the expense of USACE. Per USACE the effect of this project requires easements crossing the island to be relinquished by all parties who have an easement interest. The Department of Public Works, Right of Way Division has agreed to relinquish the easement because it is no longer needed.
