PURPOSE: Approval of Amendment No. 1 to the franchise granted by Ordinance No. 22-063 authorizing limited use of the public road rights-of-way in Snohomish County, Washington to Intermountain Infrastructure Group, LLC

BACKGROUND:
? Intermountain Infrastructure, LLC, a Delaware limited liability corporation, has applied to Snohomish County for an amendment to a non-exclusive franchise to construct, operate and maintain a telecommunication system in public rights-of-way in unincorporated Snohomish County.
? Ordinance 22-063 was approved and the agreement took effect February 14, 2023. The maximum term of the proposed Franchise is twenty (20) years.
? The original agreement specified limited portions of unincorporated Snohomish County contained within that Ordinance 22-063 and the approved Engineer's Report.
? Since that time, the franchisee requested to extend the geographical limits of the franchise agreement to all unincorporated areas within the boundaries of Snohomish County.
? Public Works commonly allows franchise agreements that are inclusive to all these unincorporated areas.
? Additional language has been included in the amendment to allow for the potential future assessment of franchise agreement fees. This language was added to all agreements shortly after Ordinance 22-063 was approved.
