PURPOSE: Notice of Amendment of Hearing Examiner Rules 3.3 and 4.7(b). Rule changes take effect unless Council modifies or rejects them. SCC 2.02.090 (2012).
BACKGROUND: The Hearing Examiner amends Rules of Procedure 3.3(b-f) and 4.7(b), effective August 15, 2023. The amendment to rule 3.3 establishes deadlines for responding and replying to pre-hearing motions. The amendment to rule 4.7(b) requires the party with the burden of proof in an appeal to file its exhibits before the other party. The amendments were disseminated to solicit public comment, and one comment was received. Council approval is not required. The amendments take effect unless Council modifies or rejects the amendments by motion. If Council modifies the amendments, the Hearing Examiner will incorporate the modification within ten days of adoption of the modification motion. SCC 2.02.090 (2012).
