PURPOSE: To update Snohomish County Code in accordance with the NPDES permit requirements from the Washington Department of Ecology.

BACKGROUND: This ordinance amends Snohomish County Code (SCC) to update drainage regulations and administrative rules consistent with the 2024 Phase I Municipal Stormwater Permit Issued by the Washington Department of Ecology. The scope of this non-project action is largely dictated by the regulatory update Ecology is requiring the County make, as described in Appendix 10 of the 2024 Phase I Municipal Stormwater Permit and in the 2024 Ecology Stormwater Management Manual for Western Washington (SWMMWW). The changes include the following: Redevelopment thresholds for road related projects, commercial projects, and industrial projects; Project exemptions; Wetland hydroperiod protection method 2; Minimum requirements and definitions related to minimum requirements; Runoff treatment performance foal thresholds and light rail dispersion BMP; Source control BMPs; Bioretention BMP; Stormwater facility maintenance standards; and Started construction standard The following regulations and rules are proposed to be amended to reflect those updates: chapters 30.63A, 30.63B, and 30.91 SCC; SCC 30.70.310; the Snohomish County Drainage Manual; and the Engineering Design and Development Standards (EDDS).
