PURPOSE: For County Council to review and take action on the Catapult Annexation by the Lake Stevens Sewer District.

BACKGROUND: The Lake Stevens Sewer District's ("Sewer District") has proposed the Catapult Annexation that is approximately 25.92 acres and contiguous to the existing Sewer District's service boundaries as well as within the Sewer District's planning area and within the City of Lake Stevens (City) corporate boundaries. The general location of the proposed sewer annexation is east of North Machias Rd, south of 28th St NE, and north of Machias Cutoff Rd. There are no other sewer providers in the City or the Lake Stevens Urban Growth Area (UGA). This is a petition method annexation for which the Sewer District submitted a Notice of Intention (NOI) to the BRB for the Catapult Annexation that was filed on February 9, 2026 (File No. 2026-02). The BRB 45-day review period will end on March 26, 2026, at 4:00 p.m. However, per RCW 57.02.040(2), the County Council must, within thirty days of receiving notice of the proposed action, approve the action or hold a hearing on the action and transmit to the BRB a report of its approval or disapproval of the proposed action together with its findings and recommendations under RCW 57.02.040. The 30-day review period for County Council to act on the proposed sewer annexation expires March 11, 2026. Based on County review, PDS concludes that the Catapult Annexation proposal, BRB File No. 2026-02, is consistent with the applicable statutory provisions governing special district annexations.
