PURPOSE: Approval of motion extending the time for WaveDivision I, LLC D/B/A Astound Broadband to accept nonexclusive cable franchise authorizing limited use of the public road rights-of-way in Snohomish County, Washington

BACKGROUND: - County Council adopted Ordinance 25-073 on December 4, 2025, approving the grant of a nonexclusive cable franchise to WaveDivision I, LLC D/B/A Astound Broadband, authorizing the use of public rights-of-way for the installation and maintenance of their cable system.
- Section 2 of the Franchise Ordinance required Wave to accept the franchise within 90 days of the passage and approval of the ordinance. This required returning a signed copy of the ordinance, providing acceptable proof of insurance, and payment of recording fees for the ordinance, among other things.
- The 90-day deadline for Wave's acceptance was March 4, 2026. By that time, Wave had returned the signed copy of the ordinance and submitted proof of insurance, which the Risk Manager approved. However, due to some confusion over the acceptance requirements and deadline, Wave neglected to pay the ordinance filing fee by the deadline, which was paid on March 24, 2026.
- This motion extends the time for acceptance to allow the franchise agreement to take effect. Public Works has no issues with allowing this extension for the franchisee's convenience.
