PURPOSE: Council acceptance of the supporting justification for approving a pending bid exceeding the engineer's estimate by more than 10 percent for construction of the SR 530 Slide Memorial project.

BACKGROUND: SCC 3.04.165 requires council approval based on supporting justification for a public works bid exceeding the engineer's estimate by more than 10 percent. Bidding on the SR 530 Slide Memorial construction project (PW-22-005SB) resulted in the lowest responsive bid at 11.2% above the engineer's estimate. The engineer's estimate was lowered in Bid Addendum No. 3 to reflect a change in the scope of the project and cost savings; and yet construction prices have been rising over the past 12 months, resulting in the engineer's estimate anticipating a greater cost savings than what the bidders proposed. The engineer's estimate as originally issued on 07/28/2022, prior to lowering it in Bid Addendum No. 3, was within 6% of the lowest bidder's total. Construction for this project needs to begin in the fall of 2022 to stay on track for scheduled completion before the 10-year memorial ceremony for the landslide event. This timeline will also allow for significant cost savings if mitigation plantings can be installed prior to the onset of the winter rainy season to aid in their establishment and long-term survivability. The adopted 2022 CIP includes funding for the project that exceeds the lowest bidder's total. The project construction timeline is important to the community's survivors, victims, and responders of the March 22, 2014 landslide event.
