PURPOSE: Council authorization of the Executive to accept funds from the Port of Everett for use at Kayak Point Park for the purpose of updating the pier as part of a planned water quality project. The motion also allows the Executive to identify personnel authorized to execute agreements and amendments, conduct day-to-day activities and handle property and real estate transactions, as needed for successful funding acceptance and project construction.
BACKGROUND: The Port of Everett and Puget Soundkeeper Alliance are signing a Consent Decree to settle a dispute regarding National Pollution Discharge Elimination System (NPDES) permit requirements. As part of the settlement, the parties have identified Snohomish County's Kayak Point Park pier piling replacement project as an ideal candidate for receiving supplemental environmental project (SEP) funds. The funds can only be used for the water quality project planned at Kayak Point Park in Snohomish County. Once the project is completed, the County will provide the Court, the United States, and the parties in this case a report describing the work done on the project and showing how the funds were spent. The County is proposing to use the SEP funds to improve water quality in Puget Sound through a project to remove creosote pilings and replace them with steel pilings at a recreational fishing pier located in a public regional park that is owned and managed by the County.
