PURPOSE: Authorizing the County Executive to sign an interlocal agreement between Snohomish County and the City of Bothell concerning reciprocal mitigation of transportation impacts from development.

 

                     BACKGROUND: Snohomish County code (SCC) 30.66B.720 provides the regulatory authority which allows the County to condition land-use approvals to require developments to mitigate their transportation impacts on city streets. 

                     SCC 30.66B.720(1) also provides that mitigation requirements for impacts to city streets be established consistent with the terms of an interlocal agreement as authorized by SCC 30.61.230(6) and RCW 39.34

                     The last Interlocal Agreement on Reciprocal Mitigation of Transportation Impacts between the County and the City of Bothell (City) was adopted October 17, 2016.

                     The City and County desire to re-enter into an Interlocal Agreement for the Reciprocal Mitigation of Transportation Impacts from Development (Agreement).

                     The Agreement would continue to require City developments subject to the Agreement to mitigate their impacts to the County’s road system, and County developments subject to the Agreement to mitigate their impacts to the City’s street system.

                     Substantive changes in the agreement:

                     Simplifying the administration of the agreement by no longer requiring an analysis of the impact on “cost-basis projects” for calculating mitigation amounts and including instead new formulas based on the percentage of boundary-crossing trips (peak-hour or average daily trips),

                     Strengthening safety by requiring mitigation of Inadequate Road Conditions consistent with County Code, and

                     Introducing updated provisions for ultimate capacity and multimodal corridors consistent with County Code.
