PURPOSE: To authorize the County Executive, by Ordinance, to execute an Interlocal Agreement Between Snohomish County and the Tulalip Tribes of Washington for the Community Floodplain Solutions Phase II Project.
BACKGROUND: The County was awarded grant funds from the Washington State Department of Ecology to implement the Community Floodplain Solutions Phase II project. The Grant provides funding to advance the implementation of integrated floodplain management in the Snohomish Watershed, with focus on the lower Skykomish River, the Snohomish River mainstem, and Snohomish Estuary. Community Floodplain Solutions (CFS) aims to increase ecological function, reduce impact from flooding, and protect and enhance farmland productivity, through property acquisition, farmland conservation, implementation of agricultural viability and floodway projects, and design of large-scale integrated floodplain projects. The Grant identifies Tulalip Tribes as a project partner and requires the County and the Tribes to enter into an Interlocal Agreement with one another to complete the Riley and Haskel Slough Conveyance and Connectivity Improvements, including feasibility analysis to identify drainage improvements and fish habitat restoration projects for the Riley and Haskel Sloughs The County and the Tribes wish to enter into an agreement entitled “Interlocal Agreement between Snohomish County and the Tulalip tribes of Washington to Implement the Community Floodplain Solutions - Phase II Project” The total cost of proposed Agreement is $773,294 to complete the Scope of Work as detailed in Appendix A or the Interlocal Agreement, of which the Tribes will match $128,882. The Washington State Department of Ecology Grant Agreement No. SEAFBD-2123-SnCoPW-00013, awarded to the County will fund $644,412. The Tribes will fund a match amount of $128,882. If approved, the Interlocal Agreement will be in effect through June 30, 2025, at which point the project activities are projected to be completed. This Agreement is entered into under the regulatory authority of the Interlocal Cooperation Act, Chapter 39.34 RCW.

DEPARTMENT FISCAL IMPACT NOTES: The WA Dept. of Ecology will reimburse $644,412 under the Floodplains by Design Phase 2 grant, awarded to the County. The Tulalip Tribes will provide the remaining $128,882 as match.
