PURPOSE: The purpose of this agreement is to set forth the mutual obligations, responsibilities, and rights of the County and Alderwood Water & Wastewater District for the performance of the Utility Work for the Fish Passage Culvert Replacement Project Near 23325 Locust Way.
BACKGROUND: The County’s Surface Water Management has a proposed 2023-28 Capital Improvement Plan (Project #WC8885) to replace the fish passage culvert near 23325 Locust Way, (the “Project”). The Alderwood Water & Wastewater District has facilities in the County right-of-way pursuant to a franchise and, as a condition of its franchise and state law, is responsible to relocate its facilities, when necessary, at its own expense to accommodate County initiated public improvements. AWWD has requested the County incorporate construction and relocation of water lines and associated utility work in the project vicinity into the County’s construction contract. All costs associated with the utility work will be paid by AWWD. RCW 39.34, the Interlocal Cooperation Act, authorizes governmental cooperation between public entities to provide services and facilities in a manner that will best serve the needs of local communities.

DEPARTMENT FISCAL IMPACT NOTES: The Alderwood Water & Wastewater District will reimburse all costs to the Surface Water Management Fund. Project costs are included in the approved 2023 Surface Water Management Fund.
