PURPOSE: To obtain Council approval of PW-23-013SB Change Order 08

 

BACKGROUND: The County and Bayley Construction, LP entered into an agreement on July 28, 2023, for the Elections Balloting Facility Remodel on the third floor of Admin West. This Change Order covers an Owner caused delay in the work pursuant with RCW 4.24.360. The asbestos abatement work, as separate contract by the owner not the general contractor, was delayed in starting due to difficulty in both the contract negotiations and the ability to find skilled abatement workers capable of passing the County’s background checks. Thus, the start of the general contractor’s scope of work was delayed by four months. The General Contractor has requested additional compensation to cover the costs directly incurred due to this delay in accordance with the RCW. Per SCC 3.04.140(4), this change order increases the contract above the Executive’s authority and now requires Council approval by motion.
