PURPOSE: Notice of violation letter to Washington State Department of Ecology as required by NPDES Municipal Stormwater Permit.
BACKGROUND: The Washington State Department of Ecology (Ecology) issued a National Pollutant Discharge Elimination System (NPDES) Phase 1 municipal stormwater permit to Snohomish County and five other municipalities in Washington State.
The County is required to submit a notification to Ecology within 30 days of becoming aware that noncompliance with the permit has occurred.
On July 24, 2025, the County investigated a report of sewage discharge to the County’s stormwater infrastructure. The County determined that the discharge had occurred and took immediate action including sending an enforcement notice to the property. However, the County did not meet General Condition G3 to notify Ecology within 24 hours of having knowledge of a discharge into the MS4 which could constitute a threat to human health, welfare, or the environment.
The County should have made the G3 notification by July 25, but did not make the notification until July 30. The County must submit the G20 notification letter to Ecology no later than August 24, 2025.
