PURPOSE: Update SCC 30.28.120 to amended separation distances between cannabis retail facilities and update name references from marijuana to cannabis in germane cross-references.

 

BACKGROUND: Staff have recently evaluated the appropriateness of varying separation distances amongst different zones. Several provisions in SCC 30.28.120 differ substantially from state standards and peer county regulations. In Washington Administrative Code (WAC) section 314-55-155, separation distance regulations are limited to 1,000 feet between marijuana retail uses and specific restricted locations (schools, playgrounds, etc.), as in King County, Pierce County, and Thurston County. Everett has the same separation distance of 1,000 feet to specific restricted locations, and a separation distance of 2,500 feet to any other legally established marijuana retailer. This code amendment would adjust separation distances for various zones to match peer governments.
