PURPOSE: To approve a motion to amend a Contract for Legal Services between Harrigan Leyh Farmer & Thomsen LLP and the Prosecuting Attorney for the civil lawsuit, Civil Survival Project, et al. v. State of Washington, et al.
BACKGROUND: The Prosecuting Attorney’s Office entered into a contract with Harrigan Leyh Farmer & Thomsen LLP in April 2021 for the provision of services regarding the civil lawsuit, Civil Survival Project, et al. v. State of Washington, et al. The original contract indicated that compensation would not exceed $50,000. In June 2021 the Council approved and the Executive signed an amendment to the contract stating that compensation would not exceed $200,000. As litigation continues, the Prosecuting Attorney is requesting approval from the Council of a second amendment in which compensation is not to exceed $400,000. The duration of the contract is unspecified. The expectation is that the contract will end when the lawsuit ends. The ECAF requests the Council to approve the motion that allows the Executive to approve the increase in the compensation limit.
