PURPOSE: This is an amendment of a multi-year contract with Landau Associates Inc. to assist in the implementation of the Department of Ecology Agreed Order (AO).
BACKGROUND:
This Agreement is the product of County RFQ No. 23-004BC and Landau Associates Inc. was selected as the most qualified company to perform the services required by the Department of Ecology Agreed Order.
On February 1, 2023, Ecology formally terminated Airport’s enrollment in the VCP and deemed the site too complex, and an Agreed Order would be required.
The airport, with assistance of its attorneys, has negotiated an Agreed Order (AO) with the Department of Ecology that requires the County to undertake all actions for remedial work.
The services required by Ecology delineated in the RFQ include, but are not limited to, the following: Task 1: Agreed Order Remedial Investigation/Feasibility Study Work Plan, Task 2: Remedial Investigation Field Work and Report, Task 3: Interim Action(s) (if required), Task 4: Feasibility Study Report(s), Task 5: State Environmental Policy Act (SEPA) Compliance, Task 6: Public Participation, Task 7: Preliminary Draft Cleanup Action Plan. Task 8: Progress Reports.
Snohomish County Council approved a contract with Landau Associates per approved Motion 23-314 to implement the Agreed Order.
The required AO schedule of deliverables have been delayed requiring more time due to multiple site mobilizations to characterize the limits of contamination.
The Airport and Ecology have agreed it is in the best interest of the project to move forward with Interim Actions (Task 3) to clean up certain plumes that have been identified within the existing AO.
Additional funds will be needed to implement cleanup of certain plumes. Costs for engineering design, SEPA and interim action workplans are at a minimum required.
The original contract included a provision in Section 2 allowing the County to extend the agreement up to one (1) additional two (2) year term, at the sole discretion of the County, by written notice from the County to the Contractor and for additional compensation for said extension per Section 3.
Additional time beyond the extension of the current contract is necessary to implement the entirety of the AO.
The Airport requests approval of an Amendment for time and additional funds with Landau Associates Inc. NTE $2,250,000 and one (1) additional three (3) year term, at the sole discretion of the County, by written notice from the County to the Contractor.
