PURPOSE: Approval of Amendment No. 1 to the franchise granted by Ordinance No. 22-063 authorizing limited use of the public road rights-of-way in Snohomish County, Washington to Intermountain Infrastructure Group, LLC

 

BACKGROUND:
                     Intermountain Infrastructure, LLC, a Delaware limited liability corporation, has applied to Snohomish County for an amendment to a non-exclusive franchise to construct, operate and maintain a telecommunication system in public rights-of-way in unincorporated Snohomish County.
                     Ordinance 22-063 was approved and the agreement took effect February 14, 2023. The maximum term of the proposed Franchise is twenty (20) years.
                     The original agreement specified limited portions of unincorporated Snohomish County contained within that Ordinance 22-063 and the approved Engineer’s Report.
                     Since that time, the franchisee requested to extend the geographical limits of the franchise agreement to all unincorporated areas within the boundaries of Snohomish County.
                     Public Works commonly allows franchise agreements that are inclusive to all these unincorporated areas.
                     Additional language has been included in the amendment to allow for the potential future assessment of franchise agreement fees. This language was added to all agreements shortly after Ordinance 22-063 was approved.
