PURPOSE: Approve Amendment No. 1 to the License Agreement to extend the service for the 2027-2031 Fairs and amend fair schedule, restrictions on games and prizes, payment terms in Exhibit A and capital improvements in Exhibit B.
BACKGROUND: An RFP was advertised in 2022 (#22-008SB) for carnival operations (amusement rides, shows, novelties, food and games). Butler Amusements Inc. was the awardee. The Licensee and County entered into an Agreement on August 10, 2022 (Motion #22-320) for the 2022-2026 Fairs. Pursuant to Section 1.5(c), the Licensee and County agreed to extend the agreement for five years (2027-2031) and amend certain terms and conditions as set forth in Amendment No. 1, in addition to the payment terms in Exhibit A and capital improvement projects in Exhibit B.

DEPARTMENT FISCAL IMPACT NOTES: The carnival will bring additional revenue to the County by paid fair gate admissions. In addition to the minimum guarantee listed in Exhibit A, the Licensee will provide $75,000 in capital improvements, per Exhibit B.
