PURPOSE: To provide annual Snohomish County Public Facilities District Compliance Certification letter for the year ending 2025.
BACKGROUND:
• Snohomish County and the Snohomish County Public Facilities District (“PFD”) entered into an Interlocal Agreement for the development of a regional center at Paine Field on December 17, 2003.
• Addendum # 1 to the Interlocal Agreement provided for allocation of excess revenue collected by the PFD (“Aggregate Tier 2 Allocations”) and was signed on March 2, 2009.
• Addendum # 2 to the ILA created additional aggregate Tier 2 allocations for each respective PFD and was signed on January 20, 2020.
• Addendum #1 Section 5 titled Annual Compliance Certification requires the County to provide written certification on an annual basis that it is in compliance with all terms and conditions of the Interlocal Agreement including the applicable provisions of RCW 82.14.390 and the amount and sources of the 33% matching funds required by RCW 82.14.390 (4) and (5).
• Addendum #1 requires that the certification be signed by the County’s Chief Executive Officer and by the chairperson of the governing body.
• A Compliance Certification letter has been attached for signature by the County Executive and by the Chairperson of the Snohomish County Council to be signed on Council Letterhead.
