PURPOSE: To authorize Snohomish County, Sponsor of the airport, to attest to and accept FAA Grant Offer No. 3-53-0028-069-2026 for Runway 16R-34L Rehabilitation at Paine Field, and to authorize the Executive to execute the Grant Offer and transmit to the Prosecuting Attorney’s office for review and signature approval

 

BACKGROUND:

 

Q                     The northern 3,000’ of Runway 16R-34L at Snohomish County Airport/Paine Field (the Airport) has experienced deterioration of asphalt pavement related to water entering the pavement subgrade.

Q                     The airport desires to rehabilitate this facility in the summer of 2026 with an asphalt mill & overlay, as well as re-grade the adjacent infield turf to improve drainage.

Q                     Snohomish County has received the attached grant offer from the Federal Aviation Administration (FAA) in the amount of $22,150,542 for reimbursement of eligible construction and engineering expenses for this project.

Q                     The grant offer requires a matching local contribution of 5%, not expected to exceed $1,165,818.  The required matching funds will be provided from the Airport fund.

Q                     The grant may be amended for up to an additional 15% if necessary to cover any eligible expenses incurred during construction.

Q                     The Airport seeks authorization for the County to attest to and accept the Grant Offer and the Executive to execute Grant Offer No. 3-53-0028-069-2026, and the Prosecuting Attorney’s Office to execute the certification of Sponsor’s Attorney, and further authorization for the Airport Director to approve any amendments thereto (not to exceed 15%).

Q                     The grant offer requires the Sponsor ratify and adopt all assurances, statements, representations, warranties, covenants, and agreements contained in the Project Application and incorporated materials referred to in the grant offer, and by such acceptance of the grant offer agrees to comply with all of the Grant Assurances, terms, and conditions in the grant offer and in the Project Application.

Q                     The grant offer requires the Sponsor’s attorney, the Prosecuting Attorney’s office, to confirm Sponsor is empowered to enter into the Grant Agreement under the laws of the State of Washington, and that the actions taken by said Sponsor and Sponsor’s official representative, who is duly authorized to execute the Grant Agreement, is in all respects due and proper and in accordance with the laws of the said State; and Title 49, United States Code (USC), Chapters 471 and 475; 49 USC §§ 40101 et seq., and 48103; Consolidated Appropriations Act, 2024 (P.L.118-42); Consolidated Appropriations Act, 2025 (P.L.119-4); Consolidated Appropriations Act, 2026 (P.L. 119-75); FAA Reauthorization Act of 2024 (P.L.118-63); and the representations contained in the Project Application.

The grant offer has special terms relating to applicable federal litigation, of which Snohomish County is a party, relating to conditions that will not be imposed or enforced to the grant funds awarded, provided that should DOT prevail in the litigation, then DOT will require that Snohomish County agrees to the original conditions and terms if Snohomish County wishes to continue with the grant in place and further that DOT’s acceptance of County’s redlines does not preclude DOT from enforcing any term in DOT’s original language that is outside the scope of the federal litigation preliminary injunction (PI) and if the PI is lifted, DOT will require that County agree to the original terms and conditions if they wish to continue with the grant in place.
