PURPOSE: To vest the Snohomish County Council with all rights, powers, immunities, functions, and obligations of the Snohomish County Transportation Benefit District after determining that such assumption is in the public interest, thereby consolidating governance and improving efficiency in administering transportation revenues.

 

BACKGROUND: • The Snohomish County Transportation Benefit District (TBD) was originally established in July 2011 as an independent governing body. • Under the original structure, the Snohomish County Council (County Council) acted in an ex officio capacity as the governing board of the TBD.

• In 2015, the Washington Legislature enacted RCW 36.74.010, which permits counties-by ordinance or resolution-to assume the rights, powers, functions, and obligations of a TBD, thereby consolidating its operations under the county's direct governance.

• RCW 36.74.030 authorizes a county legislative authority, after receiving testimony and determining that the public interest or welfare would be satisfied, to assume the rights, powers, immunities, functions, and obligations of an existing TBD.

• If the County Council chooses to assume these powers, the assumption must be made by ordinance or resolution, and the county is vested with every right, power, immunity, function, and obligation previously granted to the TBD.

• Assumption of powers consolidates TBD functions under the county’s governance structure, eliminating the need for a separate TBD board and reducing administrative duplication.

• Upon assumption, the independent governing body established pursuant to RCW 36.73.020 will be dissolved, and all authority is transferred to the County Council as the governing board, with the Snohomish County Executive providing administrative oversight.

• This action is intended to improve efficiency, accountability, and cost-effectiveness in the administration and oversight of the TBD revenues.

• The assumption of powers also ensures that decisions regarding TBD funding and project selection are directly integrated into county transportation planning and budgeting processes.

• By exercising its authority under RCW 36.74.030, the county positions itself to more effectively manage TBD revenues and respond to transportation preservation and mobility needs identified in county and regional transportation plans.
