PURPOSE: Approval of Amendment No. 2 to an Interlocal Agreement between Snohomish County and the City of Bothell concerning the design of road improvements to 228th St SE from 35th Avenue SE to 39th Avenue SE.
BACKGROUND: In 2019 under Ordinance 19-050 the County and City (the “Parties”) entered into an ILA for a joint project to design improvements to 228th St SE from approximately 400 feet west of 35th Ave SE, to approximately 300 feet east of 39th Ave SE, and approximately 150 feet south on 35th Ave SE and north on 39th Ave SE, hereinafter referred to as the “Project.” A portion of the Project is located within the City, with another portion located within the County, as depicted in Exhibit A of the Agreement. The City, on behalf of the Parties, applied for a Federal Surface Transportation Program Grant (the “Grant”). The Grant is administered by the City and will partially fund the costs associated with the design and right of way services. The original Project consisted of widening 228th St from three to four lanes with bike lanes, intersection improvements, curbs, gutters, sidewalks, lighting, signals and signal interconnect. To date, one amendment has been executed by the Public Works director within the Council approved contingency amount. If approved, Amendment No. 2 will add Design, Right of Way and Acquisition services to the agreement in order to purchase needed parcels related to the Project. Design and Right of Way services are now estimated to cost $2,150,180, of which the Grant will fund up to $608,840, or 86.5% of eligible costs, whichever is less. The Parties will pay the remainder, which is estimated to be $1,541,340, on a percentage basis with the City’s percentage portion being 25%, and estimated to be $487,031, and the County’s percentage portion being 75%, and estimated to be $1,171,309. To date $151,996 has already been authorized. Public Works is seeking an additional authorization amount of $1,019,313.00 to complete the work.
