PURPOSE: To authorize the County Executive to sign Amendment No. 1 to the ILA for the Lake Stevens SE ILA Annexation.
BACKGROUND: The attached ordinance authorizes the Snohomish County Executive to sign Amendment No. 1 to the existing interlocal agreement (ILA) with the City of Lake Stevens (City) and the Lake Stevens Sewer District (District) for the Lake Stevens Southeast Interlocal Annexation. Amendment No. 1 to the ILA revises the annexation effective date and revises Exhibit B by replacing the legal descriptions and adding surveyor’s maps. These amendments are necessary for the City to submit a notice of intention to the Snohomish County Boundary Review Board. Snohomish County and the City have an existing Master Annexation Interlocal Agreement (MAILA), effective October 26, 2005 concerning annexation, urban development, and the orderly transition of responsibilities and services for the City’s urban growth area. RCW 35A.14.296 provides for the annexation of a territory by a code city through an interlocal agreement process with the county that allows for affected public service providers to be a party to the interlocal agreement by providing written notice. The City Council passed Resolution 2020-17 commencing negotiations for an interlocal agreement with the county. The Lake Stevens Sewer District (District), consistent with RCW 35A.14.296(2), provided written notice of its intent to be a party to the interlocal agreement. On September 21, 2020 and December 9, 2020, the City held public meetings on the proposed Southeast ILA Annexation. As required by RCW 35A.14.296, the Snohomish County Council held a joint public hearing with the City Council and District Board on March 9, 2021, to consider Ordinance 21-005, approving the ILA and authorizing the Snohomish County Executive to sign the ILA on behalf of the county. On March 23, 2021, the City Council approved Ordinance 1112, which authorized the City Mayor to enter into the ILA with Snohomish County and the District. On March 25, 2021, the District’s Board convened and approved Resolution 996 authorizing the District’s President to enter into the ILA with Snohomish County and the City. On March 31, 2021, the Snohomish County Council held a public hearing and approved Ordinance 21-005, authorizing the Snohomish County Executive to sign, on behalf of the Snohomish County, the ILA as amended by Amendment Sheet 2 which revised the annexation effective date to July 16, 2021, and included a provision to ensure that the minimum net density of four dwelling units per acre will be maintained. The ILA was signed by all parties and became effective on May 12, 2021.
