Executive/Council Action Form (ECAF)
ITEM TITLE:
Title
Transportation Program Title VI Plan (Updated) and Title VI Annual Accomplishments and Goals Report for Federal Fiscal Year 2024.
body
DEPARTMENT: Public Works
ORIGINATOR: Manuela Winter
EXECUTIVE RECOMMENDATION: Approved
PURPOSE: Approve the updated Transportation Program Title VI Plan, including Executive signature of the Title VI Policy Statement (in Section II, pg. 2) and Title VI Assurances (in Appendix D, pg. D-5); and review the Title VI Annual Accomplishment and Goals Report for Federal Fiscal Year 2024.
BACKGROUND: • Under Title VI of the Civil Rights Act of 1964 and other related federal nondiscrimination statutes no person in the United States, on the ground of race, color, or national origin, shall be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance. • U.S. Department of Transportation (USDOT) implementing regulations in 49 CFR Part 21 and 23 CFR 200 require the Washington State Department of Transportation (WSDOT) to ensure all local agencies receiving USDOT funds administered by WSDOT comply with these regulations. • Each local agency must develop a Title VI compliance document (i.e., Title VI Plan) that reflects its individual federal-aid transportation program structure and submit it to WSDOT for their Office of Equity and Civil Rights (OECR) review and approval. WSDOT then in turn reports to the USDOT. • The Title VI Plan is to contain current information, and local agencies must submit updated Plans and Annual Reports to the WSDOT OECR and copy the Region Local Programs Engineer/Highways and Local Programs, for review and approval. • Any time there are substantial revisions to the County’s Title VI Plan, including administrative changes in our Title VI Program administrative structure and staffing, we are required to submit an updated Plan to WSDOT. • WSDOT requires the Executive to personally sign the Updated Title VI Plan, including the Policy Statement and Title VI Assurances where noted. WSDOT is continuing to allow electronic signatures. • With recent WSDOT feedback on our Plan, there are format and content changes to our Title VI Plan. WSDOT LAG Manual Ch. 28 changes relating to Annual Reporting, has resulted in some changes in what and how we present data for our Annual Report. • Requesting signature of County Executive Dave Somers on the Annual Report and Plan Update.
