PURPOSE: Ongoing compliance with RCW 84.34, enacted by the state legislature to “maintain, preserve, conserve and otherwise continue in existence adequate open space lands for the production of food, fiber and forest crops, and to assure the use and enjoyment of natural resources and scenic beauty for the economic and social well-being of the state and its citizens” and that “assessment practices must be so designed as to permit the continued availability of open space lands for these purposes.”

 

BACKGROUND: Applicant no longer meets the agricultural income requirements for the Open Space Farm & Agriculture classification and is seeking reclassification under Open Space General - Agricultural Conservation for three non-contiguous parcels of 6.48, 1.6471, and 7.97 acres respectively. 

The subject parcels are currently zoned General Commercial in the City of Marysville and situated along the Smokey Point Blvd arterial, where commercial development of the subject property appears imminent. RCW 84.34.037(2) states that “In determining whether an application made for classification or reclassification under RCW 84.34.020 (1) (b) and (c) should be approved or disapproved, the granting authority may take cognizance of the benefits to the general welfare of preserving the current use of the property that is the subject of application, and shall consider: (a) The resulting revenue loss or tax shift…” 

Further, as the parcel is highly unlikely to be returned to income-producing commercial agricultural use given its commercial zoning and the degree to which its environs have been developed, if County and City Councils were to approve this application for Open Space reclassification, Open Space General - Land would be more appropriate than Open Space General - Agricultural Conservation under the given circumstances.

As applicant submitted application in 2023 and there have been delays in routing the application to council, and because the properties’ location within the City of Marysville’s jurisdiction will require (RCW 84.34.037 (1)(a) “A granting authority composed of three members of the county legislative body and three members of the city legislative body in which the land is located…” or (b) “separate affirmative acts by both the county and city legislative bodies where both bodies affirm the entirety of an application without modification or both bodies affirm an application with identical modifications”, expedited processing is requested.
