EXECUTIVE RECOMMENDATION: Approved by Ken Klein 7/15/25
PURPOSE: To approve Change Order #12 to authorize payment to the Contractor, Marshbank Construction Inc. for added work associated with the disposal of existing soils that were found to contain petroleum products.
BACKGROUND: Snohomish County and Marshbank Construction entered into agreement #CA04-24 on March 29, 2024, for construction of the 36th Ave W & 35th Ave W, 164th ST SW to SR99 Improvement Project The project unexpectedly encountered the presence of Class II petroleum-based materials in the existing roadway subgrade and soils. Removal and disposal of these Class II materials is required to construct the roadway improvements. The project is limited in the disposal of these materials and disposal cost is higher that disposal of clean soils. Marshbank Construction is entitled to renegotiate compensation due to this unforeseen condition. The 35th/36th project is in Council District 3.
