DEPARTMENT:  Public Works

ORIGINATOR:  Lori Ericsson

EXECUTIVE RECOMMENDATION:  Approved by Ken Klein 5/28/25

PURPOSE: Approval of Motion Authorizing the County Executive to Sign a Statutory Warranty Deed to the City of Mill Creek

BACKGROUND: In December 2005, Snohomish County and the City of Mill Creek entered into an Interlocal Agreement concerning the disposition of 35th Ave SE and Wetland Mitigation Tracts within the annexation of land known as the Northeast Area.  There were three mitigation sites identified in the environmental permit documents for the 35th Ave SE corridor project: “Buffalo Farm,” “Penny Creek,” and “Tanaka Trust.”  Per the Agreement, the County was to retain ownership of the “Buffalo Farm” mitigation site until such time that the monitoring term set forth in the environmental permits were concluded.  The County has fulfilled its responsibilities for the Buffalo Farm site according to permit requirements and therefore, needs to convey the Buffalo Farm site to the City of Mill Creek. Please be advised that this document must be notarized.  Once the document is finalized and due for manual signature, it will be delivered in person for execution.  Please ensure the availability of both the signer and a notary at a mutually convenient time and location.
