PURPOSE: The purpose of this agreement is to dispose of waste aqueous film-forming foam (AFFF) through the Department of Ecology no cost disposal program.
BACKGROUND:
• In December 2022, Congress directed the FAA to prepare a transition plan to ensure an orderly move to MILSPEC F3 for aircraft firefighting aka perfluoroalkyl and polyfluoroalkyl substances (PFAS) Free AFFF.
• Pursuant to RCW 70A.400.020(2)(b), the Washington State Department of Ecology finds that federal regulations have changed to allow the use of alternative firefighting agents that do not contain PFAS at airports that are subject to 14 C.F.R. Sec. 139.317(k) (“Section 139 Certificated airports”).
• Ecology has created a free voluntary AFFF disposal program for qualifying fire departments.
• The Airport requests the County Executive to sign the Participation Agreement with the Department of Ecology.
