EXECUTIVE RECOMMENDATION: Approved
PURPOSE: To obtain Executive approval of Change Order 31 to Marpac Construction.
BACKGROUND: The County and Marpac Construction entered into an agreement on December 18th, 2024, for the construction phase of the New Start Center of Everett. The City of Everett Building Inspector noticed the cast iron bathtubs in the back building extend to the wood frame stud walls. The condition stops the gypsum board, which should extend to the floor deck to create a UL listed fire-resistance rated and tested assembly. The entire project team met with the Building Official onsite to discuss possible solutions. The meeting took three weeks to arrange as the Building Official was experiencing health issues and is the only person legally allowed to make the desired type of code determination. The result was the requirements to provide fire-rate caulking between the cast iron and the gypsum board. Cast iron is non-flammable and has a higher melting point than the PVC fire sprinkler piping. There is also an argument to be made that the tub to wall joints were existing conditions which are not subject to the requirement of the new building code, essentially being grandfathered into compliance. Also, the condition also existing in the front building, but was not required to be upgraded. The cost of the change has been negotiated down by $7,702. The work itself will take approximately one week. The subcontractors preforming the work were reassigned to another project while we awaited the meeting with the building official. All told, the project lost 37 days to the critical path.
